USMCA

Based on Annex 23-A of the Treaty, the reform of the Federal Labor Law met the very specific demands of the United States and Canada to guarantee Freedom of Association, Free Collective Hiring and Independent Labor Justice by Mexico. The reform establishes systems for the election of union leaderships through personal, free and secret voting. In order to demand the signing of collective bargaining agreements, unions must obtain a “Proof of Representation” to demonstrate that they have the support of a minimum of 30% of the company's workers. Collective bargaining agreements of both federal and local competence must be registered at the Federal Center for Labor Conciliation and Registration and must be ratified by the majority of the workers, this in a similar manner to the union and collective bargaining agreements’ certification system of the United States and Canada. The Federal Center for Labor Conciliation and Registration will also be responsible for the registration of all unions, whether of federal or of local competence. All existing collective bargaining agreements must be ratified within a period of four years from the effective date of the Law, otherwise, they will be extinguished.

Ratification of the USMCA

The Mexican Senate ratified the USMCA on June 19, 2019; subsequently, in the process of ratification by the United States and Canada, a Protocol of Amendment for the USMCA was agreed upon; this protocol was ratified by the Mexican Senate on December 10, 2019. The Protocol added Annex 31-A, corresponding to the United States, which includes verification systems for compliance with labor obligations, this implies the establishment of arbitration panels and the possibility of the application of economic penalties to the companies that fail to comply with the labor rights of their workers. Additionally, in accordance with the Law for the ratification of the Treaty adopted by the United States Congress, the creation of an intergovernmental agency in charge of verifying the compliance with labor rights and the placement of a minimum of 5 labor attaches in their Embassy in Mexico is foreseen. An Annex 31-B, corresponding to Canada, was also added and it also establishes verification mea sures and penalizations for breaches in regard to labor rights.
